The basis on which you use Nesema.

This document describes how the platform is built and intended to operate, but it has not yet been reviewed by a qualified solicitor and is not a binding agreement. It must not be relied on until that review is complete.
What Nesema is
Nesema is a platform that connects patients with independent holistic health practitioners, and gives those practitioners tools to run their practice. We provide the software. We do not provide health care.
What Nesema is not
Nesema does not provide medical advice, diagnosis or treatment, and nothing on the platform should be taken as such. It is not a substitute for care from your GP or from NHS services.
Nesema is not an emergency service. If you need urgent medical help, contact NHS 111, or call 999 in an emergency.
Practitioners are independent
Practitioners on Nesema are self-employed and independent. They are not our employees or agents. They set their own fees, hours, cancellation terms and clinical approach, and they are responsible for the care they provide and for maintaining their own professional registration and insurance. We verify registration at the point of joining, but the practitioner-patient relationship is between you and them.
Your account
You must provide accurate information and keep your login details secure. You must be 18 or over to create an account. We may suspend an account that is being used in breach of these terms, or where we are required to do so.
Bookings, fees and cancellations
Session fees are set by the practitioner and shown before you confirm a booking. Cancellation terms — including how much notice is required — are also set by the practitioner and shown on their booking page. Payments are processed by Stripe, and refunds are handled according to the practitioner's stated terms.
Acceptable use
Do not use Nesema to harass others, to misrepresent your identity or qualifications, to upload content you have no right to share, or to attempt to access records that are not yours. Practitioners must not use patient data for any purpose beyond the care of that patient.
Availability
We work to keep Nesema available and your data safe, but we do not guarantee uninterrupted access. We may need to suspend the service for maintenance, and we may change or withdraw features.
Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law. Subject to that, our liability relating to the platform is limited, and we are not liable for the clinical care provided by an independent practitioner.
The scope and limits of this clause require legal drafting before launch.
Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
